EatBetter.AI Terms of Use

INTRODUCTION

Welcome to EatBetter.AI (the "App"), operated by Keep Technology PTE. LTD., together with its affiliates and related entities ("EatBetter.AI," "we," "us," or "our").

These Terms of Use ("Terms" or "Agreement"), together with any documents expressly incorporated by reference (including our Privacy Policy), govern your access to and use of the App.

Please read these Terms carefully before using the App. By downloading, accessing, or using the App, you agree to be legally bound by these Terms. If you do not agree, do not use the App.

IMPORTANT NOTICE:

These Terms require the use of binding arbitration on an individual basis to resolve disputes rather than jury trials or class actions. See Section 9 below.

1. OVERVIEW

1.1 Eligibility

You must be at least 16 years old (or the age of legal majority in your jurisdiction) to use the App.

1.2 Personal Use Only

The App is provided for personal, non-commercial use only.

1.3 No Medical or Professional Advice

EatBetter.AI provides food recognition, nutrition-related insights, and eating suggestions for informational and educational purposes only.

The App does not provide medical advice, diagnosis, or treatment and is not a substitute for professional medical, nutritional, or healthcare advice.

Always seek the advice of a qualified professional before making significant dietary or health-related decisions.

2. APP FEATURES AND SERVICES

2.1 Core Functionality

EatBetter.AI allows users to:

Upload food photos for AI-based food recognition
Receive estimated nutrition information and eating suggestions
View AI-generated food-related insights

The accuracy of food recognition and analysis may vary. Results are estimates only.

2.2 Service Availability

We strive to provide stable service but do not guarantee uninterrupted or error-free operation. The App may be unavailable due to maintenance, updates, network issues, or factors beyond our control.

3. SUBSCRIPTIONS AND PAYMENTS

3.1 Paid Services

Certain features of the App require a paid subscription. Subscription details, pricing, and billing periods will be clearly disclosed before purchase.

All payments are processed exclusively through Apple's In-App Purchase (IAP) system.

3.2 Billing and Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
Your Apple ID account will be charged upon confirmation of purchase
You can manage or cancel your subscription through your Apple ID account settings

3.3 Free Trials

We may offer free trials from time to time. If not canceled before the trial ends, the subscription will automatically convert to a paid subscription.

Free trials are limited to one per user unless otherwise stated.

3.4 Refunds

Refunds are handled solely by Apple in accordance with Apple's App Store policies. We do not issue refunds directly.

4. USER CONTENT

4.1 Ownership

You retain ownership of any content you submit to the App, including food photos or text inputs ("User Content").

4.2 License

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and display such content solely for the purpose of providing and improving App functionality.

4.3 Responsibility

You are solely responsible for the User Content you provide and represent that you have all necessary rights to submit such content.

5. INTELLECTUAL PROPERTY

All rights, title, and interest in and to the App, including its design, software, algorithms, text, graphics, and trademarks, are owned by or licensed to EatBetter.AI.

Except for the limited license granted to you, nothing in these Terms transfers any intellectual property rights to you.

6. ACCEPTABLE USE

You agree not to:

Use the App for unlawful or harmful purposes
Interfere with or disrupt the App's operation
Attempt to reverse engineer, copy, or misuse the App
Upload content that is illegal, offensive, or infringes third-party rights

We reserve the right to suspend or terminate access for violations of these Terms.

7. DISCLAIMER OF WARRANTIES

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT:

FOOD RECOGNITION RESULTS WILL BE ACCURATE
THE APP WILL BE ERROR-FREE OR UNINTERRUPTED

USE OF THE APP IS AT YOUR OWN RISK.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EATBETTER.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA OR PROFITS.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) FOR THE APP DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. DISPUTE RESOLUTION & ARBITRATION

9.1 Governing Law

These Terms are governed by the laws of the State of Delaware, excluding conflict of law principles.

9.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the App shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) on an individual basis.

9.3 Class Action Waiver

YOU AGREE THAT CLAIMS MAY ONLY BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A CLASS OR REPRESENTATIVE ACTION.

10. TERMINATION

We may suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or applicable law.

11. CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be communicated through the App or other reasonable means. Continued use of the App after changes take effect constitutes acceptance.
